What Is the California FTB Offer in Compromise Program?

An Offer in Compromise is an agreement between a taxpayer and the FTB that allows eligible individuals or business entities to settle an undisputed state tax liability for a lower, lump-sum amount.

What Basic Prerequisites Must You Meet to Apply?

To be considered by the FTB, three requirements must be met:

Filing Compliance: Must have filed state tax returns up to the current tax year.

Necessary Living Expenses: Costs incurred on the average day, including housing, transportation, and medical expenses, etc.

What Documents Do You Need to Prove Qualification?

For an OIC application (Form FTB 4905PIT for individuals), you are required to have complete documentation of your inability to pay:

  • Mortgage statements, property tax assessments, and loan payoff information.
